WE HAVE A NO CANCELLATION POLICY
Five Star Vacation Rentals, Inc. books units at Kontiki Beach Resorts, Bayfront Condominiums at Kontiki, Key Allegro, Laguna Reef, Rockport Cottages, and also has independent homes and other off-site properties. This confirmation applies to all rental units.
Thank you for booking with Kontiki Beach Resorts (Five Star Vacation Rentals, Inc). Our booking policies and resort policies are intended to give each and every guests the best possible stay with us. The enjoyment and safety of your entire stay and vacation experience is our goal. Thank you for observing our policies. We will see you on your arrival day.
You must be 25 years of age or older to reserve and book a vacation property. This Rental Agreement is a legally-binding agreement between the guests, Kontiki Beach Resorts (Five Star Vacation Rentals, Inc.), and the homeowner. By making a reservation with us, you are agreeing to the terms and conditions as stated below. These terms and conditions were updated May 1, 2020. You may not book a reservation for someone younger than 25 years of age, unless you are staying in the rental unit with them. For group bookings, an adult must be in the same unit with guests 17 years old and younger. PRIOR TO YOUR ARRIVAL you are required to give all names of guests who will be staying in your unit.
Upon check-in, you will be required to show your current driver’s license identification. If you are paying for two or more units, you must provide at least one person's current valid driver’s license as being the person responsible for the guests in that additional room. At check-in, if this information is not provided, we will be unable to allow check-in and no refunds will be given.
You will be contacted by phone prior to yur arrival regarding check-in information. Upon arrival, you will need to complete a guest form and list each of your guests’ full names. For all guests younger than the age of 17, we will need their name and age.
MAXIMUM OCCUPANCY - The maximum number of people allowed in each unit is stated on your reservation confirmation. It also states how many adults and children are in your group. Please make sure this is accurate. If there is a discrepancy about the number of people allowed in your party, please call immediately and discuss this with the booking office PRIOR TO YOUR ARRIVAL. The occupancy limits are set by the Homeowners Associations and are strictly enforced. All children, regardless of age, are considered an occupant. IF YOU ARE FOUND TO HAVE EXCEEDED THE MAXIMUM OCCUPANCY LIMIT OF YOUR UNIT, IT WILL BE CONSIDERED A BREACH OF CONTRACT AND WILL RESULT IN IMMEDIATE EVICTION, LOSS OF YOUR SECURITY DEPOSIT, AND NO REFUNDS OR REBATES. We reserve the right to come to the rental unit and check the number of people using the facilities.
RESERVATION REQUIREMENTS – There is a NO-CANCELLATION POLICY. To continue to offer our guests the absolute best product and availability, we have a strict NO-CANCELLATION POLICY.
VISITORS AND PARTIES - Renters are not allowed to invite guests to the rental units for parties, bbqs, weddings, or for use of the facilities if it is going to put you over the maximum occupancy limits for your condo or rental unit. The units and its amenities are strictly for the use of the renters. If you want to have a gathering with people other than in your rental group you will need to make arrangements to do so at a public place or meeting facility off site. You can call us if you need help finding such places. Violating this policy can result in loss of your security deposit and eviction from the property. RVs, campers, or trailers ARE NOT PERMITTED at any of the properties.
Please note we have a zero tolerance for trespassing. Our guests' safety is important, and we are diligent about who are guests are, and any person(s) on our property who are not a registered guest, or homeowner will be asked to leave. If they do not leave promptly, the Rockport Police Department or the Aransas County Sheriff’s department will be called and Citations for Trespassing will be written.
PARKING - When you check in, you will receive a parking pass. This pass is required to identify your vehicle while on our properties. All boat trailers, motorcycles, or any motorized vehicle must have a valid parking pass authorized by Kontiki Beach Resorts. Please make sure you have this pass visible when using our back 500-foot fishing pier. Parking is limited to one vehicle per unit in Kontiki Beach Resorts. In Bayfront Condominiuims at Kontiki, guests are allowed 2 parking spaces. One space is numbered to match the condo/unit you are renting, and the other space is first-come, first-serve. After the second vehicle, we can not guarantee inside parking.
GOLF CARTS are NOT ALLOWED ON THE PROPERTY. This is a Homeowners Association policy and is strictly enforced.
SECURITY DEPOSIT -The security deposit amount will be authorized to your credit card at check in. Should there be any damages, you agree the damage amount will be automatically charged to your credit card. By making and confirming your reservation, you are agreeing to this action.
HURRICANE POLICY - There are no refunds due to inclement weather including hurricanes. You may purchase vacation rental insurance.
In the event of a pandemic, and the Governor closes down hotels, your reservation will be allowed to be moved to another date, but no refunds. Again, this is only if we are ordered to close due to a pandemic that effects the health of our guests and local residents.
PET POLICY – Nightly and weekly stays are not permitted to have a K-9 pet or any pet/animal in their unit. If a guest is staying 30 days or more, the Homeowners Association allows you to bring your K-9 with the proper shot records and vaccinations. These records must arrive one week prior to your arrival to ensure your pet is free of any illness, and not contagious to other pets. A non-refundable pet fee is charged per stay for all pets. Absolutely no more than 2 pets allowed. K-9 pets must be completely housebroken, well behaved, and pest free. Pets are not allowed on furniture. Guests will be charged for additional cleaning for removing pet hair and other pet-related material from furniture or the yard. Guests may not use any unit-provided linens or towels on pets. Guests agree to pay for any damages caused by pets. If pets have an accident in the rental unit, all clean-up will be performed by the guests. Guests must agree to clean up all outdoor pet waste and deposit in outside garbage cans. Any outdoor pet waste not picked up by the pet owner, will be charged $25 per pick-up. Guests agree to be in full control of their pets at all times and take full responsibility for their pets well being. Area leash laws must be followed. Rockport leash law states all K-9 pets must be on a leash and in control by their owner when outside. If any of these Pet Policy items are not met, Guests are in violation of this Agreement. Guests agree by signing this Agreement, they are authorizing Agents to charge guests' credit card on file for any damages sustained as a result of pets. BRINGING A PET TO A HOME THAT DOES NOT ALLOW PETS WILL RESULT IN IMMEDIATE EVICTION, LOSS OF SECURITY DEPOSIT, AND NO REFUND OR REBATES. No pets are allowed in the pool enclosure.
No cats are allowed.
ADDITIONALLY, you may not leave your pet, or anyone’s pet, in your vehicle. Any vehicle found to have a pet left unattended, will be visited by the Rockport Police Department or the Aransas County Sheriff’s department. The safety of all pets is important. Call the front desk and we can provide phone numbers for kennel services and pet resorts.
ALL PETS MUST BE ON A LEASH WHEN OUTSIDE THE CONDO. NO EXCEPTIONS.
DAMAGE, CLEANING, AND MAINTENANCE - Each unit is privately owned, furnished, and equipped by the homeowner. Guests agree to take responsibility for treating the home with care. Do not remove furnishings or kitchen items and do not move furniture around. Rearranging or moving of furniture is prohibited and may result in additional fees due to extra housekeeping services. Guests agree to properly use and operate all furnishings, appliances, home entertainment items, BBQs, etc. during stay. Guests will be charged for any damage or destruction of property caused by the guest, or for extra cleaning required. Please report any problems - you will not be charged for routine maintenance and normal wear and tear. Certain areas in each rental property are locked for the owner's personal storage and guests may not access these areas. Guests are responsible for doing their own dishes and properly bagging the trash and taking it out to the dumpster prior to departure.
CABLE/SATELLITE TV - All of our properties have cable or satellite TV, however properties are individually owned, and we cannot guarantee TV channel availability. Rental properties do not necessarily offer premium packages, i.e., Movie Channels, Sports Channels, Pay-Per-View, etc. Occasionally there are interruptions in cable or satellite service due to unforeseen circumstances. We do not guarantee the availability of cable or satellite service. No refunds or rebates will be offered if cable service is down or DVD players do not work, but we will make every effort to correct the problem in a timely manner.
CONDUCT -. Occupancy and use of premises should not disturb or offend neighbors or residents by means of parties, excessive noise, obnoxious behavior, verbal abuse to anyone on site, excessive speeding through parking lot, discharge of fireworks, or any other noise-inducing mechanisms. Agents reserve the right to terminate this Agreement and evict guests with no refund or rebate who engage in these behaviors. Quiet time is 10:00 p.m. until to 8:00 a.m. Please check for seasonal pool hours when making your reservation.
BBQ GRILLS – All BBQ grills must be a minimum of 10 feet away from any wood structure per the Fire Marshall.
CHECK-IN TIME IS 3:00 P.M. -
CHECK-OUT TIME IS 11:00 A.M. - The house stewards must have adequate cleaning time to prepare the property for the next guest. Guests who do not vacate the rental property by 11:00 A.M. will be charged a MINIMUM $50 late checkout fee for each 30 minutes that guest is late in checking out. The guest understands this amount will be automatically charged to the credit card on file.
ITEMS LEFT BEHIND – are not responsible for any items guests leave behind. We will collect all items we find that are left behind and upon request, we will return these items for a $25 handling fee plus shipping costs. After 7 days, all unclaimed items will be donated to Castaways to raise money for local charitable foundations.
SMOKING - THIS IS A NO SMOKING PROPERTY. All of our units are NONSMOKING. This includes patios, decks, walkways anywhere within 25 feet of the building. IF you do smoke within 25 feet of the property in or out of your unit, you will be charged a additional fee of $325 associated with ridding the unit of smoke residue.
RELEASE OF LIABILITY - All guests agree to save and hold harmless the property homeowners and Kontiki Beach Resorts (Five Star Vacation Rentals, Inc.) owners and employees for any loss, liability, damage, or cost that may incur during occupancy on or around the property including the pools, piers, boat docks, boat launches, and bulkheads. ALL GUESTS AGREE ALL CHILDREN MUST BE ACCOMPANIED BY PARENTS OR LEGAL GUARDIANS ON THE DOCKS, PIERS, BULK HEADS, SWIMMING POOLS, STAIR WELLS, OR ANYWHERE ON OR NEAR THE WATER AT ALL TIMES. Guests assume the risk of injury or other losses relating to any recreational activities and will hold the homeowners and Kontiki Beach Resorts, (Five star Vacation Rentals, Inc) homeowners and employees harmless with respect to this.
